Article 1. PURPOSE

These General Terms and Conditions are intended to define the legal framework governing the use of and the purchase of products via the website www.sitename.com.

“Parties” refers on the one hand to Artery-Crea Ltd whose registered office is located at Martlet House, E1 Yeoman Gate, Yeoman Way, Worthing, West Sussex, BN13 3QZ,
registered with the Trade and Companies Register in England, number 6729432,

Hereinafter referred to as “the Seller”

And on the other hand,

Any individual who is a consumer and places an order via the website www.juliencarcano.com,

Hereinafter referred to as “the Buyer” or “the Consumer.”

By using this website or placing an order on it, you acknowledge that you have read these General Terms and Conditions and expressly accept them without reservation.

These Terms may be modified at any time without prior notice. It is your responsibility to check them regularly. The applicable terms will be those in effect at the time of use of the website or when the order is confirmed.

 

 

Article 2. USE OF THE WEBSITE

By using this website and placing orders on it, you agree to: 1. Use this website solely to consult or place legally valid orders; 2. Not place any false or fraudulent orders. If such an order is reasonably suspected, we reserve the right to cancel it and notify the appropriate authorities; 3. Provide us with accurate and current contact information. You authorize us to use this information to contact you when necessary.

By placing an order, you affirm that you are over 18 years old and legally capable of entering into binding contracts.

 

 

Article 3. PRODUCT AVAILABILITY

All product purchases are subject to availability. If unavailable, the Seller will inform the Consumer accordingly.

Products are presented with the utmost accuracy. However, colors may vary slightly due to screen display or browser limitations. Errors or omissions in product presentation will not engage the Seller’s liability.

 

 

Article 4. SERVICE AVAILABILITY

Products offered on this website are only available for delivery within mainland France.

 

 

Article 5. OFFER VALIDITY AND PRICES

Offers are valid as long as they are visible on the site and subject to stock availability. If a product is unavailable, the Seller will inform you before payment is validated or provide a full refund, including shipping costs, using the same payment method. No additional costs will be charged for such refunds.

All prices are listed in Euros and include all taxes (TTC). Prices in effect at the time of order confirmation will be applied. The Seller may modify prices at any time, but the price displayed at the time of the order will be the only one applicable.

 

 

Article 6. FORMATION OF THE CONTRACT

To place an order, you must follow the online purchase procedure and click “Purchase.” By doing so, you acknowledge having read and accepted these Terms and Conditions without reservation. The contract is formed upon order confirmation by the Buyer.

You will then receive an email confirming receipt of your order (“Order Confirmation”) and another confirming dispatch.

 

 

Article 7. ORDER PROCESS

The Buyer must: 

– Select the product 

– Validate the contents of the cart 

– Provide a valid email address (for confirmation and tracking) 

– Provide delivery address and phone number 

– Choose payment method (credit card or PayPal) and billing address 

– Review and confirm order details, accept Terms, and proceed to payment

The total cost is displayed on the order summary page. Payments are accepted in Pounds only.

 

 

Article 8. REFUSAL TO PROCESS AN ORDER

The Seller may refuse to process an order after order confirmation in cases such as manufacturing issues, payment incidents, or regulatory issues. In this case, full reimbursement will be provided at no additional cost.

The Seller may remove products or edit website content at any time without liability.

 

 

Article 9. PAYMENT

Payment is required in full at the time of order. Any attempt at fraud will result in legal prosecution.

Payment Methods Accepted payment methods include credit card and PayPal.
For credit card payments, the buyer must confirm their shipping and billing address, along with the selected product and total price. The buyer must then provide their credit card number, expiration date, and CVX security code to complete the order.

Credit card payments are processed securely via Stripe, which uses SSL (Secure Socket Layer) encryption to ensure that the data transmitted is protected and cannot be accessed by third parties during transmission over the network.

 

Non-Payment

The seller reserves the right to refuse delivery or fulfillment of any order placed by a customer who has not fully paid for a previous order.

Payment Verification

By clicking "Purchase", you confirm that the credit card being used belongs to you.
All orders placed on the seller’s website are subject to verification in order to prevent fraudulent activity. The seller may request additional documentation to release the order, such as:

  • Proof of address,

  • Bank statements matching the payment method, or

  • Proof of address for the recipient listed in the shipping information.

These requests will be made via email.

All credit card payments are subject to validation checks and authorization by the card issuer. If we do not receive the required authorization, we shall not be liable for any delay or failure to deliver the products, and we will not be able to enter into a contract with you.

Payment Security

To ensure secure transactions, the website www.juliencarcano.com uses Stripe's secure payment service, which, as previously mentioned, complies with SSL security standards.

 

Article 10. DELIVERY

Delivery Terms Products are delivered only to addresses within mainland UK.

Delivery Times & Shipping Policy

Shipping fees and delivery times are specified during the ordering process.

Ownership and Responsibility:
Upon delivery or pickup, you become the owner and are fully responsible for the product. Except in cases of hidden defects or product malfunction, any damage occurring after the day of delivery will be considered your responsibility and cannot be used as grounds for a refund or exchange.

 

 Important Notice:

All products shipped by the seller are carefully inspected and are in perfect condition at the time of dispatch.


If your order arrives damaged and you still choose to accept or retrieve the product, this will be considered as acceptance of the item in its delivered condition.
As a result, any damage reported after acceptance will not be attributable to the seller and cannot be used as a basis for a refund or exchange.

 

Article 11. DELAY, LOSS, DAMAGE

Delay The Seller is not liable for delivery delays once the package is with the carrier. However, cancellation is permitted if the delay exceeds 30 days.

Loss If the package is confirmed lost, you may choose between a full refund or a replacement shipment.

Damage Verified damages will be refunded or replaced at the Seller’s expense after your claim is reviewed.

 

 

Article 12. RETURNS AND RIGHT OF WITHDRAWAL

Consumers have 14 calendar days from receipt to exercise their right of withdrawal. Notification must be sent by email to connect@juliencarcano.com, stating the reason for return, and the product must be returned in its original condition within the same period. Refund or exchange will be offered at your choice.

Only standard products (model, color, size as shown online) are eligible for return or exchange.

Returned items (product and packaging) must be in original condition. The Seller will assess whether conditions and deadlines were respected. Items showing visible use or damage will not be refunded or exchanged, and the Consumer will bear return shipping costs.

Refunds will be issued within 14 days of product return confirmation.

 

 

Article 13. LIABILITY AND APPLICABLE LAW

The Seller is not liable for damage caused by improper use of products. Minor presentation errors do not incur liability.

This contract is governed by English law. Only English courts have jurisdiction regardless of delivery location or payment method.

Claims will always be considered in good faith. In case of dispute, the Consumer should first seek an amicable resolution directly with the Seller.
